INDUSTRY INSURANCE Ts&Cs UNDER ATTACK BY TRADING STANDARDS This has recently come across my desk. A remover refused to entertain a claim for damage that was made outside the 7 day limit, their customer complained to Trading Standards and Trading Standards responded to the remover, in late April 2021) as follows;- “We advised you that your customer could make a legitimate claim after the seven day time period you have stipulated. As such the above term (the 7 day claim limit in the ts&cs) in its current form is most likely to be deemed unfair and should be amended. We suggest the following alternative wording which we believe is fair and could therefore be used instead;” “You should notify us of any loss or damage as soon as reasonably possible, and preferably within 7 days, following the collection of goods by you or their delivery by us to their destination. If you fail to make a timely notification to us of such loss or damage we may not be liable”. If the” alternative wording” stands;
- Removal businesses and their insurers could be open to accept and pay claims made weeks if not months after the move and they would also be liable for damage to goods that were transported by the customer!
- I suspect underwriters would either load premiums or stop insuring goods in transit.
